General Terms of Use
These terms govern the relationship between Flights&assist and each client requesting assistance with compensation claims related to air transport disruptions.
1. Definitions
- Regulation (EC) 261/2004: the EU regulation on compensation and assistance to passengers in case of delay, cancellation, or denied boarding.
- Compensation: any monetary amount claimed from the air carrier under applicable law.
- Flights&assist: Flightsassist EOOD, UIC 204534459, a company registered in Bulgaria with legal address: city of Sofia, 21 Mayski den St, entrance C.
- Client: any natural or legal person accepting these terms and assigning claim management.
- Power of representation: authorization allowing Flights&assist to act on the client's behalf before airlines and third parties.
2. Scope
These terms are an integral part of every agreement between the client and Flights&assist. The company may update them when needed by publishing the current version on the website.
3. Conclusion of the agreement
- The client starts the request by submitting required data on the website.
- The agreement is considered concluded when Flights&assist confirms acceptance in writing (email or equivalent) or starts processing the case.
- Flights&assist may reject specific cases based on legal or feasibility criteria.
- The client declares that all submitted data and documents are accurate and that they hold sufficient authorization when acting for other passengers.
4. Service and fees
- Main model: no win, no fee. If no compensation is obtained, no service commission is charged.
- Standard commission: 30% (VAT included) of compensation actually received, excluding banking and currency conversion costs.
- If additional administrative procedures or ADR are required, total commission may be up to 35% (VAT included).
- If court proceedings are required, Flights&assist may coordinate lawyers or law firms; in that case total commission may be up to 35% (VAT included).
- Flights&assist is authorized to deduct applicable commissions and expenses before transferring the remaining balance to the client.
5. Client obligations
- Provide complete and accurate data required for claim handling.
- Do not negotiate or assign the same claim to third parties without prior consent from Flights&assist.
- Inform Flights&assist immediately if the airline pays the client directly.
- Provide accurate bank details for transfer of the remaining amount.
6. Withdrawal and cancellation
The client may cancel the agreement within 14 days of conclusion by written notice to sofiagridneva31@gmail.com, provided the claim has not already been successfully resolved before cancellation.
7. Liability
Flights&assist is not liable for delays or errors caused by inaccurate data from the client, lack of client cooperation, force majeure, or circumstances beyond reasonable control.
8. Data protection
Personal data is processed in accordance with the Privacy Policy and applicable data protection law.
9. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Bulgaria. Disputes are resolved by competent courts under applicable law.
